自古以来，同性恋便是一种客观存在的社会现象。随着时间的推移，人们对于该现象的态度有所变化。20世纪以来，平权运动的蓬勃发展，使得同性恋完成了非罪化、去病化的历史进程，在许多国家和地区实现了同性结合合法化。伴随着经济社会的发展，同时受到西方平权运动的一定影响，我国同性恋群体的人权意识不断增强，争取平等权利的呼声日益高涨，目前我国已经实现了同性恋的非罪化和去病化，但是同性结合合法化尚未实现，因此有必要就该问题进行专门的研究和探讨。现实中，同性结合的诉求无法得到满足，导致了许多社会问题，例如“骗婚”导致夫妻感情破裂、同性群体因不负忠实义务而滥交导致艾滋病等性病泛滥等等。这些问题日益严重，解决这些问题的有效途径之一便是实现同性结合合法化。同时，从保障人权、维护自由、实现平等和消除歧视偏见的角度出发，实现同性结合合法化也具备法理依据。从世界范围来看，许多国家和地区已经实现了同性结合合法化，我们可以分析比较其优劣，从中吸取经验教训，为我国同性结合合法化提供思路。域外主要的同性结合立法模式大体上可分为三类，即同性婚姻模式、民事伴侣模式和民事互助契约模式，这些模式各有优劣。从我国国情出发，民事伴侣模式比较适合。建议以我国的传统观念、伦理道德、经济社会发展状况等为基础制定《同性民事伴侣法》并构建“准家庭制度”，以解决同性伴侣的财产、子女、继承和收养等问题。《同性民事伴侣法》应当明确缔结民事伴侣自由、伴侣唯一等基本原则。同性民事伴侣的成立、效力与解除可以参照《民法典》婚姻家庭编的规定。同性民事伴侣的一方收养另一方的亲生子女时，应当办理收养手续，不能仅因形成抚养教育关系而获得亲权。同性民事伴侣双方收养子女时，应当共同收养、共同抚养。《同性民事伴侣法》的制定势必会对其他法律产生影响，因此还需要统筹做好与其他法律的衔接工作。
Homosexuality, an objective social phenomenon, has existed since time immemorial, towards which people’s attitude has changed for several times. With the booming development of Affirmative Action in the 20th century, homosexuality has no longer been considered as a criminal behavior or a disease in most countries and regions. Some countries even recognize the homosexual unions as legitimate behaviors. As discussions about homosexual groups have increasingly come into view, homosexuality in China has also no longer been considered as a criminal behavior or a disease now. However, homosexual unions are still illegal in China, as a consequence of which it’s of necessity to research on this issue.In reality, due to the dissatisfactions with the institutions that the demand for same-sex unions is not allowed, there are quantities of social problems. For instance, marriage by cheating leads to the breakdown of husband and wife. In addition, lacking of faithful obligations in homosexual groups leads to promiscuity which causes the spread of AIDs and other sexually transmitted diseases. One of the effective ways to address the increasingly severe problems is to realize the legalization of homosexual unions. Additionally, from the perspective of protecting the human rights value, freedom value, equality value and eliminating discrimination and prejudice of the homosexual groups, it’s also necessary to realize the legalization of homosexual unions.Around the world, many countries and regions have realized the legalization of homosexual unions, we can analyze and compare their advantages and disadvantages, absorb lessons from them, and provide ideas for the legalization of same-sex unions in our country. The mainstream legislative model of western countries can be divided into three categories, namely, same-sex marriage model, civil partnership model and pacte civil de solidarite model. These models have their own merits and demerits, among which I suppose that the civil partnership model is more suitable for our national conditions. It is recommended to formulate the Homosexual Civil Partnership Law and build a "quasi-family system" based on China‘s traditional concepts, ethics, morality, and economic and social development to address the problems of homosexual couples‘ property, children, inheritance, and adoption. The Homosexual Civil Partnership Law should clarify the basic principles of freedom and sole partnership in the conclusion of civil partnerships. The establishment, validity and dissolution of homosexual civil partners may refer to the provisions of the Marriage and Family Section of the Civil Code. When one of the spouses of a homosexual civil partner adopts the biological child of the other spouse, the adoption formalities shall be carried out, and parental authority shall not be acquired solely because of the formation of a relationship of custody and education. When both homosexual civil partners adopt children, they shall adopt and raise them together. The enactment of the Homosexual Civil Partnership Law will inevitably have an impact on other laws, so it is necessary to coordinate the connection with other laws.
