粤澳跨境数据流动的跨部门协同 ——基于Bryson框架的分析

摘要

在数字经济时代下,数据流通对于发挥数据蕴含的价值具有重要意义。粤港澳大湾区是我国的重点发展区域之一,其发展离不开数据的互联互通。但目前大湾区正面临着“两制”带来的一系列数据壁垒,数据流通问题正阻碍着粤港澳三地的进一步融合。面对数据流通的问题,湾区内面临的问题不单单是法律制度的差异,更是“两制”带来的文化、理念差异所导致跨部门协同问题。在现实中,后者对于政府协同建设的影响并不亚于前者。 为了探究上述问题,本文以横琴粤澳深度合作区的跨部门协同为切口,通过对粤澳跨境数据验证平台、横琴口岸“一地两检”两个案例进行访谈调研,探讨当前两地政府部门在跨境数据流动领域协同上的一些特征。在理论框架上,作者选择了Bryson的跨部门协同框架来进行研究设计与案例分析。在对两个案例进行独立分析后,本文寻找到两个案例在跨部门协同上的一些共同特征,并以其他部门人员的访谈作为补充印证案例所得。基于对案例的分析与对比,本研究提出以两地协同基本条件、协同模式、协同制约组成的跨部门协同分析框架。两地协同基本条件包括政策的合规性、技术支持等,协同模式包括跨体制和同一体制内的纵向与横向协同,协同的制约因素则包括横向协同中制度、文化的差异与纵向协同中政策创新与政策关注度阻力。针对以上研究结论,本文进一步从规则、组织管理层面提出了相应建议。

In the era of digital economy, data circulation is of great significance in bring out the value of data. The Guangdong, Hong Kong and Macao Greater Bay Area is one of the key development regions in China. Its development is inseparable from the circulation of data in the area. However, the Greater Bay Area is currently facing a series of data barriers caused by the "Two Systems", and the data circulation problem is hindering the further integration of the area. In front of the problem of data circulation, the Greater Bay Area faces not only the difference on legal system, but also the problem of cross-sector collaboration due to the cultural and conceptual differences derived from the "Two Systems". In reality, the latter has no less impact on government collaboration3 than the former. In order to dive into the above question, this paper takes the cross-sectoral collaboration in Guangdong-Macao in-depth cooperation zone in Hengqin as the starting point, and explores the characteristics of the current collaboration between the government departments of Guangdong and Macao in the field of cross-border data flow by conducting interviews and research on the “Guangdong-Macao cross-border data verification platform” and the "co-location of inspection" at Hengqin port. In terms of theoretical framework, the authors chose Bryson‘s cross-sectoral collaboration framework for the research design and case study analysis. After analyzing the two cases independently, this paper finds some common features of cross-sectoral collaboration between the two cases, and corroborate the findings with interviews from other departments. Based on the analysis and comparison of the cases, this study proposes a cross-sectoral synergy analysis framework consisting of the basic conditions of synergy, synergy model, and synergy constraints. The basic conditions of the synergy include policy compliance and technical support. The mode of synergy includes vertical and horizontal synergy across and within government systems. The constraints of synergy include institutional and cultural differences in horizontal synergy, policy innovation and resistance in gaining policy attention in vertical synergy. In view of the above findings, this paper further proposes corresponding suggestions in terms of rules and organizational management.
