本文主要研究我国的数据隐私公共化,并从数据隐私所具有的情境性入手,尝试分析我国数据隐私公共化的历史进程,以及个体态度与个体数据隐私让渡的心理机制问题。首先,本文批判性地回顾了数据隐私的现有研究,提出了“数据隐私的主体”及“数据隐私的价值”可以作为理解数据隐私公共化合理性的支撑。在此基础之上,本文将情境化隐私理论作为理解数据隐私公共化的理论进路,详细梳理了情境化隐私理论的内涵与理论脉络,在中国国家-社会关系和技术驱动语境下,确定了情境化隐私理论的理论契合性与可研性问题。在这一理论基础与研究思路下,本文通过具体研究数据隐私公共化的历史发展、个体态度和公众心理机制,完整地讨论了数据隐私公共化进程中主体、数据隐私价值、隐私规范环境等变量间的关系。第三章以从2001-2021年20年间关于隐私的学界文献与业界报道为资料,探讨了关于隐私讨论的历时性变化,包括主体流变、隐私观念以及情境的作用等。第四章则通过对500余名互联网活跃用户进行的问卷调查,对当下我国公众的数据隐私公共化现状感知、态度倾向以及相关影响因素进行了分析,发现了公权力主体与私权力主体在隐私让渡行为意向中的差异性地位,以及隐私价值感知对公民数据隐私让渡中的重要影响作用。第五章采用调查实验的方法,着重测量了主体间差异、价值感知差异以及其他主要变量的关系,发现规范环境信任作为关系性要素完全中介了主体与数据隐私让渡意向之间的关系,隐私关注与之同样作为关系性要素,但是在主体与数据隐私让渡意向之间起到调节作用,隐私价值感知则作为补偿性要素对这一中介效应具有显著的负向调节作用。最后,本文在经验研究的基础之上,综合流动的现代性理论和情境化隐私理论,提出“流动的隐私边界”作为理解当下我国数据隐私公共化的理论框架,并对其进行了理论内涵的阐释。
This dissertation mainly studies the publicization of data privacy in China, and starts from the contextual nature of data privacy, trying to analyze the historical process of data privacy publicization, as well as the individual attitudes and psychological mechanisms of data privacy transfer. First, this dissertation critically reviews the existing research on data privacy, and proposes that "the subjects of data privacy" and "the value of data privacy" can be used as the support for understanding the rationality of data privacy publicization. On this basis, this dissertation borrows privacy in context theory as the theoretical approach to understanding the publicization of data privacy, combs the connotation and theoretical framework in detail, and establishes the legitimacy and feasibility of the contextual privacy theory in the context of state-society relationship and technology-driven context in China.Under the theoretical foundation and framework, this dissertation discusses the relationships among variables such as subjects, data privacy values, and privacy normative environment in the process of data privacy publicization in a complete way by specifically studying the historical development, individual attitudes, and public psychological mechanisms of data privacy publicization. Chapter 3 explores the changes in the privacy discourse over time, including the evolution of subjects, privacy perceptions, and the role of context, using the academic literature and news reports on privacy over the 20-year period from 2001 to 2021. On this basis, chapter 4 analyzes the current public perceptions of data privacy publicization, attitudinal tendencies, and related influencing factors through a questionnaire survey of more than 500 active Internet users, and discovers the differential positions of public and platform power subjects in their intentions to obtain privacy, as well as the important role of privacy value perceptions in citizens' data privacy transfer. Using a survey experiment, Chapter 5 focuses on measuring the relationship between inter-subject differences, value perception, and other key variables, and find out that normative environmental trust as a relational element fully mediates the relationship between subjects and data privacy transfer intentions, privacy concerns play a moderating role between the subject and the intention to cede data privacy, while privacy value perception as a compensatory element has a significant negative moderating effect on this mediating effect.Finally, on the basis of empirical research, this dissertation in chapter 6, proposes the “liquid privacy boundary” as a theoretical framework, combining the liquid modernity theory and contextual privacy theory together, to explain publicization of data privacy in contemporary China, and explicates its theoretical content.
