未成年人能否适用认罪认罚从宽制度，是新时代司法体系建构中不能绕开也不易解开的难题。随着刑事责任年龄的下调、刑事处罚端口的前移，这一问题就显得更为重要。未成年人适用认罪认罚从宽制度有利于深化少年司法从宽处遇原则，维护未成年人合法权益，实现更宽广的社会公正与效益的统一。因此有必要更好地发挥制度功能，加强未成年人特殊群体与认罪认罚从宽制度的有效衔接，从而让每一个未成年人在司法程序中感受到公平正义。本文以此为着眼点，分析未成年人适用认罪认罚从宽制度的法理逻辑和特殊规则，并针对司法案例探究现实适用上存在的问题，在借鉴国外未成年人认罪协商相关制度与程序基础上，对完善我国未成年人适用认罪认罚从宽制度提出了三方面建议：一是改进具体制度，在量刑幅度上细化标准、提高缓刑适用率、限制被害人谅解的从宽效力；二是加强未成年人权利保障，构筑反悔救济机制的同时强化律师的有效辩护和完善具结程序规定；三是做好与其他未成年人配套制度的衔接，要明确合适成年人到场制度、完善社会调查制度、改进社区矫正制度。

Whether minors can apply the leniency system of guilty plea is a difficult problem that can not be bypassed or solved in the construction of the judicial system in the new era. As the age of criminal responsibility is lowered and the port of criminal punishment is moved forward, this problem is particularly important. The application of leniency system for minors is conducive to deepening the principle of leniency in juvenile justice, safeguarding their legitimate rights and interests, and realizing the unity of broader social justice and benefits. Therefore, it is necessary to give better play to the function of the system, strengthen the effective connection between the special group of minors and the leniency system, so as to make every minor feel fairness and justice in the judicial process. Taking this as the starting point, this paper analyzes the legal logic and special rules of the application of leniency system of guilty plea for minors and explores the problems existing in practical application according to judicial cases. On the basis of learning from the relevant systems and procedures of foreign minors' plea negotiation, this paper puts forward three suggestions to improve the application of leniency system of guilty plea for minors in China: first, optimize the specific system, refine the standards in the range of sentencing, improve the application rate of probation and limit the lenient effect of victim understanding; second, strengthen the protection of minors' rights, build a estoppel relief mechanism, strengthen the effective defense of lawyers and improve the provisions of signing procedures; third, the supporting system for other minors should be well connected, the appropriate adult attendance system should be clarified, and the social investigation system as well as the community correction system should be improved.
