随着人口老龄化、人民生活水平的提高和农村向城市的大规模人口流动,我国家政服务需求和供给进入高速发展期。2018年,各类家政服务机构有70万家,比上年同期增长3%;家政服务员约3153万人,同比增长13%;家政服务业(以下简称“家政业”)规模超过5700亿元,同比增长接近28%[商务部服务贸易和商贸服务业司.中国家政服务行业发展报告[R].2018。]。家政业以年均20%以上的速度发展壮大,在第三产业中表现及其亮眼。伴随着家政业的快速发展,家政服务员培训不足、诚信缺失、消费者和从业者的保障不力、服务技能评定混乱等一系列问题逐步显现,这些问题背后的深层次原因是行业法治建设的滞后。为真实呈现我国家政业法治状况,笔者学习借鉴国际上较为先进的法治评估方法——“世界正义工程”(WJP)法治评估理论,详尽阐述了我国家政业的法治建设背景,构建了测量家政业法治状况的框架,通过问卷调查量化了法治建设指标,并对结果进行分析,最后提出了意见建议。笔者构建的家政业法治评估框架设有3个一级指标、10个二级指标、31个三级指标,在兼顾法治的形式要件基础上,着重考量家政业法治实践的公开、民主、效率、公正等实质要件。调查方式上,笔者主要主要采取问卷的方式进行调查。借鉴WJP问卷调查方法和结果量化技术,笔者设计了公众调查问卷和专家调查问卷,并制定了调查结果量化方法。笔者在全国21个省、自治区、直辖市总共回收公众问卷604份,专家问卷58份。调查显示,我国家政业法治状况不容乐观,基本处于“中评”阶段。行业法制化建设仍然需要政府和社会的共同努力。家政服务尽管只是国民经济中的一个普通行业,但其中涉及的劳动者保护、消费者维权、政府监管手段创新、公民隐私保护、个人和家庭雇佣关系法律调整等内容均是当前社会治理的焦点和难点。系统研究家政业法治评估理论,科学开展法治状况评估,有利于制定出台有针对性的政策措施,建设规范、高效、健康的家政业,更好的发挥家政业应对老龄化挑战的作用。结合中国法治实践和行业实际,建议出台规制行业发展的专门性法律法规。以此为核心,构建我国家政业的法律法规体系,弥补通用法律法规与行业实际“脱节”的问题。
With the aging of the population, the improvement of people's living standard and the mass migration from rural to urban areas, the demand and supply of domestic service in China have experienced a period of rapid development. In 2018, there were more than 700,000 domestic service agencies in China, with year-on-year growth of 3%. There were 31.53 million domestic service workers in China, with year-on-year growth of 13%. Domestic service revenue nationwide exceeded 570 billion RMB, with the year-on-year growth of nearly 28%. The domestic service industry, with an average annual growth rate of more than 20%, performs well in the tertiary industry.With the rapid development of domestic service industry, a series of problems, such as insufficient training of home workers, lack of good faith of market subjects, inadequate protection of consumers and workers, and faked and chaotic assessment of workers’ skill, have gradually emerged. In order to show the status of legal construction of domestic service industry in China, this paper develop the index of legal construction in domestic service industry by referring to the "World Justice Project" (WJP) rule of law evaluation theory. The evaluation framework consists of 3 first-level indicators, 10 second-level indicators and 31 third-level indicators. The evaluation system considers the formal elements of the legal system, and focuses on the essential elements such as openness, democracy, efficiency and justice of the practice of the rule of law in the domestic service industry.Questionnaire is the main method to investigate the legal status of domestic service industry. Referred to the WJP questionnaire survey and results quantification technology, the author designed the public questionnaire and expert questionnaire, and check the results of the survey. The survey shows that the legal construction of domestic service industry in China is not optimistic, and is basically in the medium stage. The construction of industrial legalization still needs the joint efforts of the government and the society.Although domestic service is only an ordinary industry in the national economy, it is the focus and difficulty of current social governance that it involves labor protection, consumer protection, innovation of government supervision means, citizen privacy protection, legal adjustment of individual and family employment relationship, etc. Systematic research on the evaluation theory of the rule of law in domestic service industry and regular evaluation are conducive to the formulation of good policies and measures, so as to better play the role in coping with the aging society. Based on China's legal practice and industry reality, it is suggested to introduce special laws to regulate the industry. With this as the core, the legal and regulation system of domestic service industry is constructed to make up for the "disconnection" or the lack of supervision gap between general laws and regulations and domestic service industry.
