1040阳光工程型传销是一种传销活动的类型。该传销类型，存在历史较长，社会影响力较大，治理难度较大。本文专门针对此类传销类型，进行刑法学分析。 本文首先从五个方面对1040阳光工程型传销类型进行了界定，并将此传销类型当中的参与者，划分为八种事实意义上的类型。 对于1040阳光工程型传销涉及的组织、领导传销活动犯罪而言，其主要侵犯的法益，不是市场经济秩序，也不是公民财产权，而是社会性的法益。对于1040阳光工程型传销涉及的组织、领导传销活动犯罪，其基本属性是组织类犯罪，并非诈骗类犯罪。 本文最为主要内容，是对组织、领导行为的规范判断问题。 实务中在判断是否构成组织、领导行为时，存在较为机械化的做法。常见的机械化做法，一是过渡依赖行为人自身的下线的人数，二是混淆“身份”与行为。 基于规范分析，参考传销事实，本文提出判断组织、领导行为的规范标准，即“对传销活动或传销组织的存在和发展起到关键性的实质作用的行为”。依据该规范判断标准，本文对1040阳光工程型传销中的典型行为、各类事实意义的参与者进行了规范判断。 积极参与行为在实务中存在理解和适用上的混乱。对此，本文认为，积极参与行为不能规范性的评价为组织、领导行为，也不能评价为组织、领导行为的帮助行为。对于组织、领导活动罪的帮助犯，其帮助行为仅限于对组织、领导行为的帮助，个别判例将“对传销活动的开展起到帮助作用”的行为认定为组织、领导传销活动的帮助行为，这种做法并不合适。此外，帮助犯的存在需以必要共犯理论进行限定，只有超越通常性、定型性且具有刑事可罚性的帮助行为，才能构成帮助犯。 实务中对传销犯罪故意几乎不予考察。结合刑法理论和相关事实，本文提出1040阳光工程型传销犯罪故意的内涵，即“认识到该组织并非国家支持，且认识到该组织具有诈骗财物的性质”。以此认识内涵作为判断标准，本文坚持以客观判断主观的方法，提出三方面对判断传销犯罪故意具有意义的事实，并进行了具体分析。三方面事实为，（1）组织、领导行为的性质与具体内容，（2）与行为人直接相关的其他事实，（3）传销组织存在的社会环境方面的有关事实。

The common mechanized approach is that the legal understanding of the "30 people and level 3" of the MLM organization in the standard for prosecution is not in the right place. In addition, in practice, there is a transition to attach importance to the formal identity within the MLM organization, rather than to examine the performance of substantive and specific organizations and leadership behaviors. Based on the understanding and analysis of the criminal law norms and judicial interpretations, combined with the relevant facts of MLM crimes, this article puts forward the normative standards for judging the organization and leadership behavior, " the behavior of playing a crucial and substantial role in the existence and development of MLM activities or MLM organizations ". According to the proposed standard, this article made a normative judgment for the specific behaviors and types of participants in factual meaning in the 1040 Sunshine Project MLM. There are assisted offenders in the crime of organization and leadership MLM activities. In this regard, this article believes that the help behavior is limited to help the organization and leadership behaviors. In practice, The help criminals who have found this crime by "helping the development of MLM activities" is not suitable. In addition, there is confusion in understanding and application the "active participation", in practice. In this regard, this article finds that the behavior of active participation cannot be evaluated in a normative manner as organizational or leadership behavior, nor can it be criminalized according to the accomplice theory of criminal law. With regard to the deliberate problem of MLM crimes, the analysis found that, in practice, the deliberate problem of MLM crimes was hardly investigated and determined. Combining the criminal law theory and the facts of the 1040 Sunshine Engineering MLM, this article proposes the specific connotation of MLM deliberately, which is recognizing that such organizations are not supported by the government, and that such organizations have the social significance of fraudulent property. Taking this connotation as the normative judgment standard, this article insists on judging from objectively matters to objectively facts. And, this article analyzing from three aspect, the specific content of the organizing and leadership behavior, other facts directly related to the actor, and the existence environment of the MLM organization. This article believe that these three aspects are of significance in determining the intention of 1040 Sunshine Engineering MLM.
