摘要

本轮逆全球化的基点在于部分国家对国家主义与个体主义的回归,其本质是部分国家对国际利益分配失衡的对抗。从经济层面来看,一些国家在全球化过程中由于自身竞争力相对不足,在内部产生了严重的结构分化;从政治层面来看,以美国为首的部分发达国家为了避免承担决策失误的责任,将国内外矛盾引向全球化进程本身。然而上述原因均不足以阐释逆全球化的内在根源,其本质原因应是国内治理失范、全球治理与国内治理失衡所引发的各国对新时期全球治理规则制定主导权的争夺。全球化进程所引发的风险与利益分配失衡动摇了既有治理秩序,在这一背景下,作为全球治理重要组成部分的气候治理议题,将受到逆全球化趋势的负面影响。针对上述问题,本文着眼于逆全球化的内涵及原因分析,同时梳理国际气候治理机制的构建与形成过程,通过国内外不同学者的观点,结合当前的气候治理实践,总结出本轮逆全球化对国际气候治理进程推进产生的负面影响,并以此为基础,从法律与制度层面深入剖析,总结出针对负面影响的有效解决措施,尝试形成具有可行性与有效性的制度设计。文章首先从气候治理议题的地位提升、机制平衡等方面入手提出克服治理实践阻碍的应对政策;其次通过强化主体地位、治理效用的独立性及不同主体之间的良性互动来增强非国家行为体的治理成效;再次在对气候治理规则制定主导权进行分化与整合的基础上对国际气候治理的权力改革提出建议。最后本文将中国置于国际治理环境下,尝试对中国新时期的气候治理政策取向创建多种制度选择。

The basic point of this round of deglobalization is the return of some countries to nationalism and individualism. Its essence is the resistance of some countries to the unbalanced distribution of international interests. From an economic perspective, some countries have experienced severe structural differentiation in the process of globalization due to their relative lack of competitiveness. From a political point of view, in order to avoid taking responsibility for decision-making errors, some developed countries, led by the United States, attributed domestic and foreign conflicts to the globalization process. However, the above reasons are not enough to explain the internal roots of deglobalization. The essential reason is the competition among the nations for the dominance of global governance rule-making in the new period triggered by the disorder of domestic governance, the imbalance of global and domestic governance. The unbalanced distribution of risks and benefits caused by the globalization process has undermined the existing order of governance. Under this background, the climate governance issue, which is an important part of global governance, will be negatively affected by the deglobalization.In view of the above problems, this study focuses on the analysis of the connotation and causes of deglobalization, and sorts out the formation process of the international climate governance mechanism. Then, based on the current practices of climate governance and the views of different scholars at home and abroad, this paper summarizes the negative impacts of this round of deglobalization on the progress of international climate governance. On this basis, this paper makes an in-depth analysis from the legal and institutional levels, summarizes effective measures to solve the negative impacts, and tries to form a feasible and effective system. Firstly, from the aspects of improving the status of climate governance issues and balancing mechanisms, the paper proposes countermeasures to overcome the obstacles of governance practices. Secondly, the governance effects of non-state actors can be enhanced by strengthening the independence of subject status, governance effectiveness and positive interaction between different subjects. Then on the basis of the differentiation and integration of the dominant power of climate governance, the author puts forward some suggestions on the reform of international climate governance. Finally, this paper puts China in the international governance environment and tries to create a variety of institutional options for China's climate governance policy orientation in the new era.
