近年来,城市转型社区中以棚改旧改、城中村改造为主要内容的城市更新建设兴起,征地拆迁成为关系地方发展与稳定的重要内容。在转型社区征地拆迁的过程中,原有的治理场域发生深刻变革,相关利益主体在追求自身利益的过程中表达出不同的利益诉求,进而发生矛盾和碰撞,阻滞了转型社区的改造和更新。发展进程中产生的问题,终究需要用发展的理念和方法去解决。北湖项目是J市城市更新的重点项目,也是当地有史以来规模最大、耗时最久的征地拆迁项目。旷日持久的征迁为北湖片区带来了发展转机,也经历了巨大的社会治理考验,其经验和教训对于研究转型社区征地拆迁问题具有“样本”意义。本文以北湖片区转型社区中涉及的征地拆迁利益相关者为研究切入,以基层治理为研究视角,在布局结构上,按照提出问题、剖析问题、解决问题的思路,共分为六章。其中:第一章是绪论部分,阐述论文研究的理论背景,提出研究的三个问题、研究的目的和意义、研究的方法以及论文的结构及逻辑框架;第二章介绍研究的相关理论及文献综述情况;第三章介绍北湖项目特别是征地拆迁所涉及转型社区的案例情况,通过案例分析,得出经济补偿并不是影响征地拆迁关键因素的结论;第四章结合问卷调查的结果,分析转型社区征迁中的政府、集体、居民三个核心利益主体及其诉求;第五章以“征地、规划、安置”三个政策环节为横向维度,“集体经济组织成员房屋、非集体经济组织成员房屋、无证房”三种主要征迁类型为纵向维度,建立起“政策阶段-征迁类型”的二维分析空间,动态分析核心利益主体间的诉求冲突,通过结构背景下展开的互动研究,发现转型社区的征迁主要矛盾,焦点表现在土地权属的复杂模糊,原因在于规划管理的效率低下,而根源则在于治理体制和机制的滞后,由表及里即权属问题、规划问题、治理问题;第六章从基层治理的角度,针对问题提出了对应的政策建议,进一步对构建“政府-集体-居民”间的良性互动关系展开思考,提出以转型社区利益整合为契机,构筑网格化的精准治理空间,推进基层治理现代化,走好走实走稳高质量发展之路。
In the process of the overall demolition of the transformation community, the original governance field has undergone a profound change. Beihu Project is a key project of urban renewal in J city, as well as the largest and most time-consuming land acquisition and demolition project in local history. The protracted expropriation and relocation has brought about a turning point in the development of Beihu area and also experienced a huge test of social governance. Its experience and lessons are of "sample" significance for the study of land expropriation and relocation in the transitional communities.Based on the stakeholders involved in land expropriation and demolition in the transformation communities in Beihu area, this paper starts from the perspective of grassroots governance. The fourth chapter, based on the results of the questionnaire survey, analyzes the three core interests of the government, the collective and the residents in the transition community and their demands.
