预告登记制度是不动产登记制度中的重要组成部分,对于促进交易效率、保护交易安全具有重要意义。虽然我国法律对预告登记制度的规定日益详细,但并不完善,特别是预告登记在强制执行中的效力。目前,只有司法解释规定了预告登记在金钱债权执行中的效力。研究预告登记在强制执行中的效力,能够保护预告登记权利人的利益,同时促进强制执行的效率。依据生效判决确定的债权能否通过金钱给付,本文将强制执行分为金钱债权执行与非金钱债权执行。对于不动产,金钱债权执行程序包括查封程序、变价程序和强制管理程序;非金钱债权执行程序包括强制交付、强制办理财产证照转移程序。本文研究预告登记在具体的强制执行程序中的效力。本文重点研究我国预告登记制度中四种较为典型的预告登记,分别是不动产转让预告登记、预购商品房预告登记、不动产抵押预告登记和预购商品房抵押预告登记,研究每一类预告登记在强制执行程序中的效力。在强制执行程序不涉及对预告登记的不动产进行处分时,如在查封程序和强制管理程序中,预告登记不能阻碍强制执行程序的进行,因为此时强制执行行为并没有损害预告登记权利人的权益。但是在可以进行不动产登记时,如果强制执行影响预告登记权利人办理登记,应当解除全部强制执行;不影响时,权利人可直接申请办理,登记机构不得拒绝。当强制执行程序对不动产进行处分时,如在变价程序中,预告登记权利人有权提出异议请求法院停止对不动产的处分,法院应当支持权利人的请求。但在例外的情形下,如预购商品房无法建成,将来的物权变动确定地不能实现,法院不应当支持预告登记权利人停止处分的请求。在非金钱债权执行中,由于预告登记权利人的异议指向生效判决的内容,因此需要通过审判监督程序实现权利救济。
The advance notice registration system is an important part of the real estate registration system.The advance notice registration system is of great significance to promote the efficiency of the real estate transaction and protect the security of the real estate transaction.Although the provisions of the advance notice registration are increasingly detailed, but not perfect, especially the legal efficacy of the advance notice registration in enforcement procedures.At present,there is only one provision about the legal efficacy of the advance notice registration in the enforcement of the monetary claim.The research on the legal efficacy of the advance notice registration in the enforcement can protect the interests of the right holder of the advance notice registration, while promoting the efficiency of enforcement.In this paper, according to whether the content in the effective legal instrument can be paid through the money, the enforcement process will be divided into the implementation of monetary claims and non-monetary claims.According to the different legal efficacy , the procedures of the enforcement of the monetary claim are divided into seizure procedures, auction procedures and compulsory management procedures; the non-monetary claim procedures are divided into mandatory delivery and forced to apply for the formalities for transfer of a certificate of title.The author studies the efficacy of the advance notice registration in each specific procedures of enforcement.This paper focuses on four typical advance notice registrations in Chinese law.They are the advance notice registration of the transfer of real estate ,the advance notice registration of the mortgage of the ownership of real estate ,the advance notice registration of forward-purchased commercial house and the advance notice registration of the mortgage of forward-purchased commercial house.The author studies the efficacy of each type of advance notice registration in the enforcement process.When the enforcement measures do not dispose the real estate which the advance notice registration has been undergone, such as seizure measures and mandatory management measures,the right holder of the advance notice registration does not prevent the execution of the enforcement process,since the enforcement at this time does not affect the rights of the right holder of the advance notice registration.But when the real right registration conditions are met,if the enforcement measures prevent the right holder to apply for registration,the people's court shall uphold the right holder’s opposition to prevent enforcement.If the enforcement does not conflict with the advance notice registration,it is unnecessary to prevent enforcement measures. The real estate registration authority?should accept the application and complete the real estate registration formality.When the enforcement measures dispose the real estate which the advance notice registration has been undergone, such as auction and sale,the right holder of the advance registration has the right to raises an opposition to stop disposal of the seized real property,and the people's court shall uphold. But in exceptional circumstances,for example the forward-purchased commercial house can not be completed,at this time,it is impossible to apply for registration of transfer or mortgage. The people's court shall not uphold the right holder’s opposition to stop disposal of the seized real property.In the enforcement of the non-monetary claim,if the right holder of the advance notice registration raises a opposition,which means he deems that the effective judgment or ruling is erroneous. At this time ,the right holder of the advance notice registration needs to apply for retrial.
