摘要

《红楼梦》是一部伟大的批判现实主义著作,书中通过宝玉的视角表现了封建社会的经济、政治、文化、宗族、服制、宗教、婚姻、继承以及社会生活的各个方面,被誉为封建社会状况的百科大全,是中国古典小说四大名著之一。该书是由曹雪芹写于十八世纪,当时正处于中国封建社会的末期,西方资本主义国家的工业革命运动正在如火如荼地开展,清代统治者依然坚守闭关锁国,沉迷于天朝上国的幻想当中。但社会内部矛盾日益尖锐,反对封建礼教的人文主义思潮兴起,该书通过对封建大家庭的兴盛与衰落的描写,否定了“三纲五常”等封建礼教,高度歌颂了宝黛爱情,同情书中女性的悲惨命运,体现了作者追求人性解放和探究个体命运的人文情怀。法律不仅是写在纸面上的呆板的文字,而是包括在国家法律制度指导下的社会生活的各个方面和社会群体之间长期约定成俗的习惯法。通过从法律的角度研读《红楼梦》,我们可以发现书中描写了大量的清代时期的法律现象,特别是书中作者对女性命运的关注,是我们探究清代婚姻法律制度的运行及其对个体命运的影响的宝贵资料。本文采用“文史互证”的研究方法,从法律与文学相结合的角度去研究法律问题和法律文化,使得本文的论证更具有说服力。首先,本文阐述了《红楼梦》的创作背景和作者身世,并阐释了清代婚姻制度的特征、类型;其次,本文结合《红楼梦》中描写的法律现象对清代婚姻的缔结与解除制度进行分析;再次,本文结合《红楼梦》中刻画的众多女性的悲惨命运分析了妻和妾在清代封建婚姻中的法律地位。最后,文末总结:一夫一妻多妾的婚姻制度自西周确立以来,至清代已经非常成熟并完备,其本质是封建纲常礼教对人的束缚在婚姻方面的表现。《红楼梦》中对众多女子悲惨命运的描写,正是几千年来由封建婚姻制度导致的女性悲惨命运的缩影,因此封建婚姻制度是封建社会男权对女性摧残的工具。随着资本主义经济因素的发展,人文主义思潮的兴起,人们为了追求自由开始向封建礼教抗争,封建婚姻制度也最终走向消亡。

First of all, this article elaborates the creative background and author‘s life experience of "Dream of Red Mansions", and explains the characteristics and types of the marriage system in the Qing Dynasty. Secondly, this article analyzes the conclusion and dismissal system of marriage in Qing Dynasty with the legal phenomenon described in A Dream of Red Mansions Thirdly, this paper analyzes the legal status of his wife and concubine in feudal marriage in the Qing Dynasty in the light of the tragic fate of many women portrayed in A Dream of Red Mansions. Finally, this paper concludes that the marriage system of monogamy and concubines established in ancient China since the Western Zhou Dynasty, according to the "parents‘ life, matchmaker‘s words", "seven out", "three no", " Marriage "and other principles to run, to the Qing Dynasty has been very mature and complete. But its essence is feudal class etiquette on the human bound in the performance of marriage. The fate of many women in the Dream of Red Mansions is the epitome of the fate of women in feudal society in China for thousands of years. These are the tragedies caused by the feudal marriage system.
